John Kind Studios LLC (“JKS,” “John Kind Studios,” “we,” “us,” or “our”) is a Boston-based creative agency and production company. These Booking Terms and this Privacy Policy apply when you visit our website, submit a Project Snapshot or other form, schedule an appointment, communicate with us, apply to or participate in a JKS network, or otherwise interact with JKS through an online platform.

By submitting information or scheduling an appointment, you acknowledge this policy.

Part I: Booking Terms

1. What a Booking Means

Scheduling a discovery call, consultation, onboarding meeting, project meeting, or other appointment reserves only that meeting time.

A booking does not:

  • Confirm that JKS has accepted a project.

  • Reserve a production, recording, event, or delivery date.

  • Guarantee the availability of a particular creative professional or team.

  • Establish the final scope, price, timeline, or deliverables.

  • Authorize JKS or any member of its network to begin work.

  • Create an employment, contractor, partnership, or client relationship by itself.

Project acceptance occurs only after JKS confirms fit and availability and the required written agreements and payments are completed.

2. The JKS Project Process

Depending on how an inquiry begins, a prospective client may submit a Project Snapshot before or after a discovery call.

The standard JKS process generally includes:

  1. Inquiry, referral, or Project Snapshot.

  2. Discovery and project qualification.

  3. Scope development and written proposal.

  4. Signed client agreement or statement of work.

  5. Required initial payment or deposit.

  6. Confirmed Project Snapshot, team, responsibilities, schedule, and deliverables.

  7. Production and delivery.

JKS may request additional information before determining whether a project is appropriate, feasible, or profitable.

3. Discovery Calls and Consultations

A discovery call is an initial conversation intended to help JKS understand the project’s goals, audience, scope, budget, timeline, and production needs.

Unless expressly stated otherwise:

  • Discovery calls are complimentary.

  • Advice provided during an initial call is preliminary.

  • No project date or personnel are held during the discovery stage.

  • Any estimate discussed verbally is nonbinding until included in a written proposal.

  • Calls will not be recorded without notice and any consent required by law.

JKS may decline projects that fall outside its capacity, availability, budget requirements, values, safety standards, or service model.

4. Rescheduling, Cancellations, and No-Shows

Please reschedule or cancel an appointment at least 24 hours before its scheduled start time.

Complimentary discovery calls currently have no cancellation fee. However, repeated late cancellations or missed appointments may result in restricted self-scheduling or a requirement to confirm a future meeting directly with JKS.

If JKS must reschedule an appointment because of an emergency, illness, technical problem, production conflict, or circumstance outside its reasonable control, JKS will offer a new meeting time.

Project cancellations, postponements, refunds, and payments are governed by the applicable signed proposal, agreement, statement of work, or change order.

5. Project Pricing and Payments

All project prices depend on the approved scope, crew, equipment, location, production requirements, deliverables, timeline, licensing, and other relevant factors.

Unless a written proposal or agreement states otherwise, JKS generally requires:

  • A signed agreement before work begins.

  • A 50% initial payment or deposit before committing production dates, personnel, facilities, or other resources.

  • Payment of the remaining balance according to the signed agreement and before release of final master deliverables.

A booking-page appointment does not replace the formal proposal, agreement, invoice, or deposit process.

Additional requests, deliverables, revisions, production days, locations, or material changes may require a written change order and additional payment.

6. Institutional and Organizational Bookings

Anyone booking on behalf of a company, nonprofit organization, educational institution, government entity, community organization, artist, or other party represents that they are authorized to initiate the conversation.

Institutional requirements—including purchase orders, vendor onboarding, insurance, accessibility, data security, venue rules, licensing, approvals, and payment procedures—must be disclosed before the project is finalized.

A purchase order, procurement form, platform-generated confirmation, or institutional policy does not modify JKS’s obligations unless JKS expressly accepts it in writing.

7. Creative Network and Contractor Meetings

A partnership, network, assessment, or onboarding meeting does not guarantee:

  • Admission to a JKS network.

  • Employment or contractor status.

  • A minimum amount of work.

  • Selection for a particular project.

  • Compensation, project dates, or future opportunities.

Project participation is confirmed separately through the applicable contractor, participation, confidentiality, release, tax, and project-specific documents.

8. Confidential and Sensitive Information

An initial inquiry or booking does not automatically create a nondisclosure agreement.

Do not submit Social Security numbers, financial credentials, medical records, student education records, confidential legal records, or other regulated or highly sensitive information through a public form, chat widget, social-media message, or general booking platform.

If a project requires confidential or regulated information, the parties should establish appropriate written terms and a secure method of exchange before that information is provided.

9. Professional Conduct and Accessibility

JKS is committed to professional, respectful, and inclusive communication. JKS may end or decline an interaction involving harassment, threats, discrimination, fraud, unlawful conduct, or unreasonable safety concerns.

Clients and visitors may inform JKS of reasonable accessibility or communication needs when scheduling. JKS will work in good faith to determine appropriate accommodations within the scope and circumstances of the meeting or project.

10. Third-Party Booking Platforms

JKS may use third-party services such as Squarespace, Setmore, Tawk.to, Google Workspace, payment processors, video-conferencing platforms, and other operational tools.

Use of those services may also be governed by the provider’s own terms and privacy policy. JKS is not responsible for outages, errors, or independent data practices controlled solely by a third-party provider.

11. Order of Precedence

If these Booking Terms conflict with a signed JKS proposal, client service agreement, statement of work, NDA, data-processing agreement, participation agreement, or other project-specific contract, the signed project-specific document will control.

12. Governing Law

These Booking Terms are governed by the laws of the Commonwealth of Massachusetts, without limiting any rights that cannot legally be waived.

Part II: Privacy Policy

1. Information We May Collect

Depending on how you interact with JKS, we may collect:

Contact and identity information

  • Name

  • Company or organization

  • Professional title or role

  • Email address

  • Telephone number

  • General location

  • Social-media or portfolio links

Project and booking information

  • Project goals and descriptions

  • Requested services

  • Budget and timeline

  • Event, production, or meeting dates

  • Location and venue information

  • Deliverable requirements

  • Appointment history

  • Project Snapshot responses

  • Accessibility or communication requests voluntarily provided to us

Professional network information

  • Résumé, biography, portfolio, reel, or work samples

  • Availability, rates, equipment, and service area

  • Agreement and onboarding status

  • Contractor or payment information when required for an engagement

Payment and transaction information

JKS may receive transaction confirmations, payment status, billing contact information, and limited payment records. Full card or bank credentials are generally processed by the applicable payment provider rather than stored directly by JKS.

Technical and usage information

Our website and service providers may automatically collect information such as:

  • Browser and device type

  • Pages visited

  • Referral source

  • Date and time of access

  • Cookies and similar technologies

  • General website and booking-page activity

  • Respond to inquiries and communicate with you.

  • Schedule and manage appointments.

  • Assess project fit, scope, budget, staffing, and feasibility.

  • Prepare proposals, agreements, Project Snapshots, invoices, and production documents.

  • Assemble and coordinate an appropriate creative or production team.

  • Deliver services and manage active projects.

  • Process payments and maintain accounting records.

  • Operate the JKS Creative and Production Networks.

  • Evaluate professional qualifications and project availability.

  • Improve our website, booking process, services, and communications.

  • Maintain security, prevent fraud, and enforce agreements.

  • Meet legal, insurance, tax, accounting, and regulatory obligations.

  • Send operational messages and, where permitted, relevant company updates.

4. How We Share Information

JKS may share information only as reasonably necessary with:

  • Service providers that support scheduling, website hosting, communications, storage, payments, analytics, accounting, contracts, or production operations.

  • JKS employees, contractors, and creative professionals who need the information to evaluate or perform a project.

  • Prospective clients when presenting an authorized professional profile, portfolio, work sample, availability, or project-fit assessment.

  • Professional advisers such as attorneys, accountants, insurers, or consultants.

  • Government agencies, courts, or other parties when required by law or reasonably necessary to protect legal rights, safety, or property.

  • A successor entity if JKS undergoes a merger, acquisition, restructuring, or sale, subject to applicable law.

JKS does not sell personal information.

JKS will not use a person’s name, image, likeness, voice, portfolio, or work for an unrelated endorsement or public campaign without the permission or agreement required for that use.

5. Artificial Intelligence and Project Materials

If artificial-intelligence tools are considered for a client project, their permitted role, disclosure, licensing, and treatment of project materials may be addressed in the applicable proposal or agreement.

JKS will not knowingly use confidential client materials, protected personal information, or a person’s voice or likeness to train a generative-AI model or create an unauthorized digital replica without appropriate written authorization.

6. Cookies and Analytics

Our website and third-party platforms may use cookies or similar technologies to operate essential features, remember preferences, measure traffic, understand how visitors use the site, and improve performance.

Browser settings may allow you to block or delete cookies. Disabling certain cookies may affect website or booking-page functionality.

7. Data Retention

JKS retains information only for as long as reasonably necessary to:

  • Respond to an inquiry.

  • Evaluate or complete a project.

  • Maintain business and project records.

  • Administer the JKS networks.

  • Comply with tax, accounting, insurance, contractual, or legal obligations.

  • Resolve disputes or enforce agreements.

  • Protect the security and integrity of JKS operations.

Retention periods may vary according to the type of record and applicable requirements. Information that is no longer reasonably required may be deleted, anonymized, or securely archived.

8. Data Security

JKS uses reasonable administrative, technical, and physical safeguards appropriate to the nature of the information and the size and scope of the company.

No internet transmission, email system, cloud platform, or storage method can be guaranteed to be completely secure. If JKS becomes aware of a covered security incident, JKS will respond and provide legally required notifications in accordance with applicable law.

9. Your Choices and Privacy Requests

You may contact JKS to request:

  • Access to personal information we maintain about you.

  • Correction of inaccurate information.

  • Deletion of information that is no longer required, subject to legal and contractual recordkeeping obligations.

  • Withdrawal from nonessential marketing communications.

  • An explanation of how information associated with your inquiry or project is being used.

JKS may need to verify your identity or authority before completing a request. Certain records may be retained when required for legal, security, accounting, contractual, or dispute-resolution purposes.

Operational communications concerning an appointment, contract, payment, active project, or legal obligation may continue even if you opt out of promotional messages.

10. Children’s Privacy

The JKS website and general booking services are intended for adults and authorized organizational representatives. They are not directed to children under 13.

When JKS provides services involving minors, project and booking information should be submitted by a parent, legal guardian, school, institution, or other authorized adult. Any additional permissions, releases, or safeguards required for a youth-centered project will be handled through separate project documentation.

11. Third-Party Links and Services

Our website, messages, or booking pages may contain links to third-party websites or services. Their privacy and security practices are governed by their own policies.

We encourage visitors and institutional clients to review the policies of any third-party platform they choose to use.
